Thank you for using Believ and our electric vehicle charge point network across the UK.
These terms and conditions (“Terms”) tell you who we are, how we will provide our services to you, our tariffs and other important information about using our network.

The Terms contain important information about how you can locate our charge points, how you can start a charging session, the steps you must take to keep your Believ Account secure, restrictions on using the Services, how we or you can end the Services and our limitations on our liability to you.

PART 1 – INTRODUCTION

1.1. Believ is the trading name of Liberty Charge Limited, incorporated in England and Wales with registered number 12231122 whose registered office is at Griffin House, 161 Hammersmith Road, London W6 8BS. (“Believ”, “us”, “our” or “we”).

1.2. These Terms apply to all users of our Services now and in the future in the United Kingdom.

1.3. Before using the Services, you should read these Terms carefully.If you do not agree to these Terms, you must not access or must stop accessing, the Services.

1.4. If you have any questions about these Terms or wish to notify us of any of the matters referred to in these Terms, please contact Believ by:

(a) telephoning our customer service team at 0800 0515335;

(b) by sending us an email at [email protected]; or

(c) by sending us an enquiry via the Website contact us function

together these are our “Contact Details”.

1.6. In these Terms:

App

is our mobile software application called Believ;

Believ Account

is the account you set up through the Website or App by registering your email address, creating a password, and registering a payment card;

Believ Map

is the map of our Charge Points and their individual Tariffs. The Believ Map is accessed via the Website (Believ – Find A charge point) or App;

Believ Network

is Believ’s network of electric vehicle charging infrastructure which enable you to recharge your electric vehicle using our Charge Points; 

Business User

you are considered a business user if: (i) you register a VAT number in your Believ Account; and/or (ii) the vehicle receiving the Services belongs to your employer or is otherwise used by you in connection with your trade, business, craft or profession;

Charge Point

is a charge point on the Believ Network that connects your electric vehicle to our electricity supply, allowing the vehicle’s battery to be charged;

Charging Session

is the period of time during which an electric vehicle is connected to a Charge Point calculated from the period between the “start transaction” and “stop transaction” signals from the Charge Point to Believ’s back-office and management platform, regardless of whether electricity is flowing at the time;

Contact Details

has the meaning in section 1.5;

Contactless Payment Card

is a debit, credit, prepaid or charge card, sticker, mobile phone or other device that is used to make contactless payments and which can be used to pay for Charging Sessions at Charge Points;

Direct Debit

is an arrangement made with your bank authorising us to collect payments from your account when they are due to us;

Guest User

is a user of the Services and Believ Network who is conducting a Charging Session either by Contactless Payment Card or without a Believ Account;

Membership Plan

are plans with particular benefits that may be available from time to time to Registered Users;

Overstay Fee

is the per-minute charge for any time that your vehicle is connected to a Charge Point but is not actively drawing electricity;

Pay As You Go Tariff

is our default Tariff;

Registered User

is a user of the Services and Believ Network who is conducting a Charging Session with a Believ Account;

RFID Card

is a radio frequency identification card issued to you either by us or by a Third Party Roaming Provider which contains an embedded chip to enable you to begin, end and pay for your Charging Session;

Secondary User

is a Registered User whose Believ Account is linked to another Registered User (“the Main Registered User”) and whose Charging Sessions are paid for by the Main Registered User;

Services

are the electric vehicle charging services which are accessed via our Website, our App or via Contactless Payment Card or RFID Card that we provide to you on these Terms;

Tariff

is the cost of electricity in pence per kWh as displayed on the Believ Map available through Charging Points on the Believ Network;

Third Party

is a party who is not you or us;

Third Party Roaming Provider

is an e-mobility service provider or roaming provider who provides a payment service in respect of different networks of public charge points; and

Website

is our website at www.believ.com

PART 2 – The Believ Map 

2.1. Charge Points on the Believ Network and the associated Tariffs can be viewed on the Believ Map which is available on our Website (Believ – Find A charge point) and App.

2.2. To use our Website, App and Believ Map you must have an internet-enabled device.

2.3. Our Website and App are made available for users in the United Kingdom aged 18 and over only.

2.4. We strive to provide the most accurate information possible through our Website, App and Believ Map, but we cannot guarantee the accuracy of the information provided. Neither Believ nor any third party service provider guarantees that the information displayed through the Believ Map is correct or up to date.

2.5. If you require any support when using our Website, App or Believ Map, please contact us using our Contact Details.

PART 3 – Using the Website, App and Believ Map

3.1. Believ may change the format, content and/or functionality of all or any part of the Website, App or Believ Map at any time.

3.2. All or part of the Website, App or Believ Map may be unavailable for use if we undertake any maintenance activity.  We will seek to minimise any time the Website, App or Believ Map are unavailable for use.

3.3. Updates to the Website, App or Believ Map may be issued from time to time. It is your responsibility to ensure that your internet-enabled device has the latest software and firmware updates applied to it and is capable of operating the latest version of the Website, App or Believ Map. 

3.4. Believ may enforce or implement any security measures it deems appropriate at any time and may update and add security measures to the Website and/or App at its discretion at any time.

PART 4 – Tariffs

4.1. Before you begin a Charging Session you must first use the Believ Map to confirm the Tariff at your chosen Charge Point.  You will be deemed to have accepted the Tariff by starting a Charging Session.

4.2. The total price you pay for charging your electric vehicle will be dependent upon:

(a) the location of the Charge Point;

(b) the time of day;

(c) the type of the Charge Point;

(d) if you are a Registered User; and

(e) if a Membership Plan applies.

4.3. All Tariffs, charges and rates displayed on the Believ Map are inclusive of VAT and displayed as pence per kWh.

4.4. Overstay Fees may apply to your Charging Session. The current Overstay Fees can be viewed at Our Pricing | Believ

4.5. Membership Plans for Registered Users

(a) Registered Users may sign up for a Membership Plan. To sign up for a Membership Plan:
(i) you will need to login to your Believ Account on the Website or App and select a Membership Plan that best suits you; and
(ii) if a monthly fee applies to the selected Membership Plan, this must be paid monthly in advance from the date you sign up to the Membership Plan.

(b) If your Membership Plan allows for a discounted Tariff, such discount will only be applied to a Charging Session started through your Believ Account via the Website, App or by your RFID Card. You will not receive your discounted Tariff if you pay for your Charging Session by Contactless Payment Card.

(c) You may cancel your Membership Plan at any time by emailing [email protected]

(d) We may cancel your Membership Plan if you fail to pay any monthly fee applicable.

4.6. Taxi charging plan for Registered Users
(a) If you hold a valid private hire driver’s licence you may be eligible for our taxi charging plan where you will be exempt from Overstay Fees (“Taxi Charging Plan”).
(b) To be eligible for a Taxi Charging Plan you will need to:
(i) have signed up to a Membership plan;
(ii) hold a valid private hire driver’s licence (we reserve the right to request photographic evidence of this on a reasonable basis);
(iii) use at least 120kWh each month on the Believ Network calculated from the date you sign up to the Taxi Charging Plan.

(c) To request to be moved onto the Taxi Charging Plan you must email a photo of your valid private hire driver’s license to [email protected] quoting your Believ Account number. Your request will be processed by our team within 5 business days. We will send an email to the email address linked to your Believ Account to confirm once this has been done.

(d) We will remove you from the Taxi Charging Plan:
(i) if you fail to provide satisfactory evidence that you continue to hold a valid private hire driver’s licence; or
(ii) your usage is below 120kWh in 3 consecutive months calculated from the date you signed up to the Taxi Charging Plan; or
(iii) you fail to pay for your Membership Plan.

(e) We may provide 30 days’ notice by email to the email address we have on your Believ Account if we have grounds to remove you from the Taxi Charging Plan

4.7. Our Tariffs, Overstay Fees, Membership Plan and all other fees and charges in place now or in the future are subject to change at any time without prior notice to you.

PART 5 – Guest User & Contactless Payment Card

5.1. You are a Guest User (i) if you use a Contactless Payment Card; or (ii) choose not to sign up for a Believ Account; or (iii) you are a Registered User but choose to not start your Charging Session through your Believ Account via the Website, App or by your RFID Card.

5.2. As a Guest User you will have access to: –

(a) Believ’s Pay as You Go Tariff as displayed on the Believ Map;

(b) contactless payment;

(c) the Services without having to provide us with any personal data, download the App or open a Believ Account with us; and

(d) a receipt for your Charging Session, if you provide your email address prior to beginning a Charging Session (not available for payments via Contactless Payment Card).

5.3. Using a Contactless Payment Card as a Guest User

(a) You can use your Contactless Payment Card to pay for Charging Sessions on the Believ Network where the Charge Point gives contactless payment as an option.

(b) Believ’s Pay As You Go Tariff as displayed on the Believ Map will apply to all contactless Charging Sessions.

(c) Before you begin a Charging Session you must first use the Believ Map to confirm the Tariff at your chosen Charge Point. You will be deemed to have accepted the Tariff by starting a Charging Session.

(d) Paying with your Contactless Payment Card
(i) When you touch your Contactless Payment Card on a card reader at the Charge Point when prompted, you are giving authorisation for the cost of your Charging Session including any additional fees associated with your Contactless Payment Card or your Charging Session, to be charged to your Contactless Payment Card.
(ii) You must always use the same Contactless Payment Card method to start and end your Charging Session. For example, if you begin a Charging Session with a mobile device you need to end the Charging Session with that same device and not by some other method such as your card or other device. Failure to do so may mean your Charging Session will not end and the charging cable will not be released.

PART 6 – Registered Users & Use of Believ Account

6.1. You are a Registered User if you have created a Believ Account either on our Website or in our App.

6.2. To create a Believ Account, you will need to provide us with your name, email address, phone number, billing address, and payment card details. You must provide accurate and complete information and keep this up to date in your Believ Account.

6.3. As a Registered User you will have access to: –

(a) a receipt after each Charging Session and a record of Charging Sessions made using your Believ Account;

(b) the option to sign up to Membership Plans;

(c) the option to add Secondary Users to your Believ Account;

(d) the option to receive a Believ RFID Card;

(e) notifications relating to the progress of your charging session; and

(f) updates on changes and special offers on the Believ Network.

6.4. Believ RFID Card

(a) As a Registered User you may elect to use a Believ RFID Card to access the Believ Network.

(b) Using a Believ RFID Card will:

(i) enable you to link the Believ RFID Card to your Believ Account so that the Believ RFID can be used to begin, end and pay for your Charging Sessions; and
(ii) ensure you receive any Membership Plan discounted Tariff that may be applicable to your Believ Account.

(c) Obtaining a Believ RFID Card
(i) You can request a Believ RFID Card either through the Website, App or by emailing [email protected]
(ii) The initial cost of a Believ RFID card is £5, unless you are signed up to a Membership Plan that includes a Believ RFID Card.

(d) Believ RFID cards will be mailed to the Registered User at the address associated with your Believ Account. It is your responsibility to ensure at all times your account information is up to date and correct.
(i) If your Believ RFID Card does not arrive in the post and you report this to us within two weeks of requesting a Believ RFID Card, we will replace the RFID card for free.
(ii) If you fail to notify us that the card has not arrived within a two week period or you have given us incorrect address details, you will be subject to a fee of £5.00 (including VAT) for a replacement RFID card.

(e) Replacement Believ RFID Cards, including lost or stolen Believ RFID Cards, can be requested, and are subject to a £5.00 (including VAT) fee.

(f) If your Believ RFID Card is faulty, you can send it back to us for testing. We will replace faulty cards free of charge provided that the fault has not been caused by damage or wear and tear for which we are not responsible. You will have to cover the cost of postage if you send a Believ RFID Card back to us to be tested.

(g) If your Believ RFID Card is lost or stolen, or someone who is not (or is no longer) authorised to use your card has it or the card is being used fraudulently you must report this to us by calling 0800 0515335 as soon as possible. You will remain responsible for any outstanding balances and purchases made using that card for a period of 1 hour from the time you notify Believ.

(h) If you decide to close your Believ Account or cancel the direct debit associated with your Believ Account, your Believ RFID Card will cease to work.

6.5. Secondary Users

(a) As a Registered User you may add Secondary Users to your Believ Account. Secondary Users must also be Registered Users.

(b) You may add or delete a Secondary User in the Website or App.

(c) If you choose to add a Secondary User you will be responsible for:
(i) the payment of the Secondary User’s Charging Sessions;
(ii) the payment of any additional fees associated with the Secondary User including the provision of a Believ RFID Card;
(iii) keeping the Secondary Users linked to your Believ Account up to date, removing them as needed; and
(iv) immediately notifying us if a Secondary User’s account is compromised or improperly disclosed.

6.6. Keeping your Believ Account secure

(a) You are responsible for ensuring that:
(i) you are the only person who uses the Website or App installed on your internet-enabled device and you must not authorise anyone else to use the Website or App installed on your internet-enabled device;
(ii) your Believ Account password is kept secure – for example, you must not tell anyone else your password and your password must not be kept as a written or electronic record with or on your internet-enabled device; and
(iii) you are able to access any emails and communications that we send to you using the details that you provide to us. It may be necessary for you to check your email “junk mail” folders and/or make changes to your email filter settings to ensure that our emails are received directly into your email inbox folder.

(b) You must notify us immediately using our Contact Details if the security of your internet-enabled device and/or your Believ Account information is compromised, including due to:
(i) your internet-enabled device being lost or stolen;
(ii) your Believ Account password becoming or likely to become known by another person; and/or
(iii) unauthorised access to your internet-enabled device and/or your Believ Account.

(c) You acknowledge that Believ will not have any obligation to notify you or your bank of fraudulent or unauthorised charge activity or to take any action on your behalf.

(d) You acknowledge that we are under no obligation to check that any instruction or confirmation made by a Registered User through the App and/or the Website is from you.

(e) The security of your Believ Account is important to Believ. However, Believ cannot guarantee that the Website and/or App will always be available, fault-free and secure or that they will be free from viruses or other harmful programmes. You acknowledge that you are aware of and accept this risk including, without limitation, the risk that a third party may gain access to your Believ Account which contains personal and confidential information.

(f) We have the right to disable any Believ Account, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms

6.7. Closing your Believ Account

(a) These Terms will continue until you decide to close or we elect to cancel your Believ Account for the reasons set out in these Terms.

(b) Believ may suspend or cancel your Believ Account as set out at section 9 in these Terms.

(c) If you wish to close your Believ Account, you may either email us at [email protected] or call us on 0800 0515335 and we will process your request unless you have outstanding payments due to us.

(d) Please note that deleting the App will not close your Believ Account or delete the data in your Believ Account. In order to cancel your Believ Account and request that your data is permanently deleted, you must either submit the request by emailing [email protected] or calling 0800 0515335.

(e) If you close your Believ Account or we elect to cancel your Believ Account:
(i) you will be liable for any costs and outstanding charges incurred during the time your Believ Account was active;
(ii) you will be liable for any monthly payment for any Membership Plans, charges for electricity consumed until (and including) the date of cancellation and the payment of any additional fees; and
(iii) any monthly fee payable in relation to a Membership Plan will not be refunded.

(f) In order to recover any amounts outstanding upon closure or cancellation of your Believ Account, we will attempt to debit the outstanding sums via Direct Debit or against any other payment method you have registered with your Believ Account. Should this be unsuccessful, we will make further attempts to claim this in accordance with section 7.

(g) After your Believ Account is closed or cancelled, Believ may be required to retain some of your information to comply with legal and financial regulations. Please see Privacy & Cookies Policy – Believ for further information about how we retain customer information.

(h) From the date of suspension or cancellation of your Believ Account, you will no longer be able to access the Believ Network for the purposes of charging your electric vehicle.
(i) Where we have cancelled or suspended your Believ Account under section 9 in these Terms, you will not be permitted to create a new Believ Account to circumvent the suspension or cancellation.
(j) All provisions of these Terms that by their nature will survive termination will survive termination including, without limitation, this section 6, section 7 of these Terms, IP ownership provisions, indemnities and limitations of liability.

Part 7 – Payments

7.1. Authorisation payment from your payment card

(a) If you have a payment card registered to your Believ Account, you authorize us to make withdrawals from your payment card to cover the payment of any Membership Plans, Charging Sessions or any additional fees that fall due.

(b) We will debit your nominated payment card:
(i) in respect of the Services, shortly after you have completed a Charging Session; or
(ii) in respect of other amounts that may be due to us from you, seven (7) days after we notify you that the fee has become payable. Such notification will be by email.

(c) Under no circumstances will we be responsible for any overdraft or other fees charged by your payment card company or bank.

7.2. Processing Payments

(a) We will process your payment card details, including those entered into the Website and App solely for the purpose of sharing these details with our third-party payment provider.
(i) Where you have used a payment card on the Believ Network, your card details are held by us and collected, stored and processed by our third party payment services provider.
(ii) Where we are unable, due to a technical difficulty, to collect payment for our Services we reserve the right to do so as soon as practicable afterwards.

7.3. Pre-authorised holding payments

(a) In order to verify that your payment card has sufficient funds for payment of the Services our third party payment services provider will take a pre-authorisation holding payment on your card at the beginning of a Charging Session.

(b) The amount of the pre-authorisation holding payment taken by our third party payment services provider will be as follows:
(i) for Guest Users, a pre-authorisation holding payment of £30 will be taken; and
(ii) for Registered Users, a pre-authorisation holding payment of £25 will be taken.

(c) If a pre-authorisation holding payment cannot be taken for any reason, for example, if the relevant account does not have the funds necessary for the pre-authorisation holding payment, you will not be able to proceed with your Charging Session.

(d) The pre-authorisation amount will be held by us until the total fee payable for your Charging Session is debited from your payment card.

(e) Once your Charging Session is complete, the cost of the Charging Session will be debited from your payment card as follows:
(i) if the cost of your Charging Session is more than the pre-authorisation holding payment, we will take payment of the full cost of the Charging Session and your banking services provider will refund the pre-authorisation holding payment; and
(ii) if the cost of your Charging Session is less than the pre-authorisation holding amount, your banking services provider should release the remainder of the pre-authorisation payment promptly to you.
The release of the pre-authorisation holding balance is outside of our control and the time taken to do this is up to your banking services provider. Please contact your banking services provider if you have any questions regarding the release of the payment.

7.4. Failed Payments

(a) If a payment or a Direct Debit is unsuccessful you authorise us to take payment using your payment card details again (through our third party payment services provider). We will endeavour to send a notification of the failed payment informing you that we will be attempting to retake the payment. This notification will be sent to the email address registered to your Believ Account (if one has been provided);

(b) If the payment is unsuccessful again, we will re-attempt a collection any number of times until payment has successfully been collected; and

(c) If, after 3 days, we are unable to recover the outstanding sum, we reserve the right to suspend or cancel your use of the Services and your Believ Account with immediate effect and we may refer your case to a third-party debt collection agency. You will be responsible for all costs associated with the collection of the debt.

(d) If we are unable to collect any payment you owe us we will charge interest on the overdue amount at the rate of 2% a year above the Bank of England base rate from time to time. This interest accrues on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You will pay us the interest together with any overdue amount.

(e) If you have an unpaid Charging Session, you will not be permitted to use the payment card used to start the unpaid Charging Sessions until all amounts owed have been paid in full.

Part 8 – Third Party Roaming Providers

8.1. If you are a customer of a Third Party Roaming Provider who has an agreement with us, by using the Services you are agreeing:

(a) to these Terms which shall apply to the Services as well as any additional terms and conditions of that Third Party Roaming Provider which you have accepted; and

(b) where applicable, to be billed for using our Services by that Third Party Roaming Provider instead of being billed by us directly.

8.2. You must begin and end your Charging Session as specified by the Third Party Roaming Provider.

Part 9 – Suspension of Services

9.1. We reserve the right to suspend or immediately cancel your access to the Believ Network, any of the Services, the Website and/or App or your Believ Account, with or without cause or notice, at any time.

9.2. We reserve the right to refuse to provide our Services at any time should any of the following apply;

(a) we reasonably suspect fraud or illegal activity;
(b) we reasonably consider this is necessary to protect the security of your Believ Account;
(c) we cannot reasonably meet any requests you make to us;
(d) your payment card has been reported as lost or stolen;
(e) you do not pay us in full for your Charging Sessions;
(f) you do not pay us any payment owed to us in full by the date it is due; or
(g) that in providing our Services to you this would cause us to break any law, regulation, code or other duty which applies to us.

Part 10 – Personal information

10.1. When you use our Services, we will process your personal information. Our Privacy & Cookies Policy sets out the ways in which we will collect, store and process data relating to your use of our Services (including the App and the Website) and includes details of your rights to access, correct and erase any of your personal information that we hold.

Part 11 – Intellectual Property

11.1. Believ owns or has obtained a valid licence to use all copyright, trademarks and other intellectual property rights in connection with our Website, App, Believ Map, Charge Points, and the provision of the Services. All rights of ownership over and in respect of these will remain solely with Believ and/or its licensors (as the case may be).

11.2. Any use of the Website, App or Believ Map in any manner not permitted under these Terms including, without limitation, resale, transfer, modification or distribution of all or part of the Website, App or Believ Map is prohibited.

Part 12 – Using the Believ Network

12.1. When charging your vehicle on the Believ Network, such charging must be carried out in accordance with these Terms.

12.2. When charging your vehicle at our Charge Points you will do so safely and use reasonable care and skill.

12.3. You acknowledge and agree that:

(a) you will comply with all signage and instructions displayed at the Charge Point;

(b) you will review and familiarise yourself with Believ’s charging and safety instructions available at How to Charge your EV | Believ prior to using the Service;

(c) Charging cables
(i) where you are required to provide your own charging cable:
(A) you will ensure that you only use a charging cable of a standard and quality no less than that recommended by the manufacturer of your vehicle;
(B) you will not use any cable which is damaged, faulty or otherwise modified in any way;
(C) you will at all times ensure the running of the cable between the Charge Point and your vehicle is done safely and in a way that minimises disruption to the surrounding area;
(D) you are at all times liable for damage to us or third parties in relation to a charging cable you provide while using the Services;
(ii) where a charging cable is made available to you at the Charge Point for connecting your vehicle to the Charge Point:
(A) you must use this charging cable in accordance with any instructions set out at the Charge Point or How to Charge your EV | Believ
(B) you must leave the charging cable at the Charge Point when you depart;
(iii) you are responsible for disconnecting your charging cable from our Charge Points correctly once you have finished charging your vehicle;

(d) Battery
(i) you are responsible for ensuring the battery in your vehicle is compatible with using the Charge Points to charge your vehicle. You will ensure the battery in your vehicle is of a standard and quality no less than that recommended by the manufacturer of your vehicle and you will not connect your vehicle to the Charge Points should the battery be damaged, faulty, or otherwise modified in any way; and
(ii) you are at all times liable for damage to us or third parties in relation to your vehicle’s battery whiles using the Services.

(e) When using our Services, you are responsible for complying with any parking restrictions that are imposed by the local authority or car park operator.

12.4. Believ does not guarantee the performance nor continuous availability of Charging Points. Although problems are rare, from time to time they do happen. We will try to resolve such issues as soon as possible after becoming aware of them.

12.5. When using our Services you will not:

(a) assign or otherwise transfer your Believ Account;

(b) use the Believ Network, Website, App or Believ Map for any unlawful purpose, in any way that interrupts, impairs, damages the Believ Network, Website, App or Believ Map or renders each less efficient, or to transfer files that contain viruses, trojans or other harmful programmes, to access or attempt to access the Believ Accounts of other users or to penetrate or attempt to penetrate any security measures;

(c) do anything Believ reasonably considers to be disreputable or capable of damaging its reputation, the Believ Network, the Website, App, Believ Map, or the Services;

Part 13 – Third party terms

13.1. Believ uses third party applications, services and software in order to support your use of the Services including, but not limited to, payment services, identity management services, location and map services software, market analytics software, market intelligence software and rewards software, all of which may gather and report information about you in connection with your use of the Website, App and Believ Map (such as location information, device information and user content). When you use the Services you are agreeing to Believ’s use of such third-party software and services.

13.2. In some circumstances, we may use third party debt collection agencies to recover any sums due to us. By using the Services you are agreeing to Believ’s use of third-party debt collection agencies and the sharing of necessary billing and payment-related information for that purpose.

13.3. These Terms form a contract between you and us and these Terms do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 for third parties to enforce any of these Terms.

Part 14 – Liability

14.1. Believ is providing the Services and the Website, App and Believ Map to you and you are using all aspects of the Services at your own risk.

14.2. In the event you incur any losses whilst using the Services, please note that we do not compensate you for all losses. Subject to section 14.3, we are responsible for losses you suffer caused by us breaching these Terms unless the loss is:

(a) Unexpected. It was not obvious that it would happen and nothing you communicated to us before starting a charging session meant we should have expected it (so, in the law, the loss was unforeseeable);

(b) Caused by a delaying event outside our control. As long as we have complied with our obligations under these Terms we are not responsible for delays outside of our control;

(c) Avoidable. Something which could have been avoided by taking reasonable action or omitting to take action. For example, damage to your goods, including vehicle, battery or charging cable, which could have been avoided by being prudent and following instructions or advice (including how to charge, connect or disconnect) and having properly updated compatible software and hardware;

(d) A business loss. Subject to any Terms applicable to users who are not consumers, relating to your use as a Business User.

14.3. Believ is not liable to you for the following unless we have breached these Terms:

(a) any damage to you or your vehicle sustained while at the Charge Points or using our Services;

(b) any charging cable you provide becoming damaged when connecting and/or disconnecting from the Charge Point;

(c) any charging cable provided by us causing any damage to your vehicle as a result of any incompatibility between your vehicle and the charging cable

(d) any damage to your vehicle’s battery as a result of connecting and/or disconnecting to the Charge Points;

(e) any software failure resulting in the Charge Points stopping and starting and a Charging Session from being interrupted at the Charge Point;

(f) any loss of access or suspension to the Services in accordance with these Terms;

(g) any parking charge incurred by you as result of failing to correctly park or comply with any parking restrictions whilst using the Services;

(h) any inconvenience caused by any failure of the Services or any inability to charge your vehicle due to availability of the Charge Points;
(i) any changes to the number or locations of Charge Points;
(j) any third party damage to vehicles or any other third-party property;

(k) any third-party software and services embedded in the Website, App or Believ Map, including payment services;

(l) any bugs, viruses, trojans or the like provided we have taken reasonable business precautions;

(m) any suspension or loss of access to the Website, App or Believ Map or any functionality;

(n) any unauthorised use or misuse of your Believ Account for any reason;

(o) any unauthorised access to your Believ Account or any information provided using your subscription details, including payment information.

(p) any loss or damage that was not caused by any breach on Believ’s part, including any loss or damage caused by something beyond Believ’s control, such as third-party damage to the Charge Points or failures in the electricity distribution network

14.4. Nothing in these Terms shall limit or exclude Believ’s liability for death or personal injury caused by Believ’s negligence or for any fraudulent misrepresentation Believ makes to you.

14.5. You will be responsible to Believ for your negligence or breach of these Terms or, where appropriate, any third party terms.

Part 15 – Changes to these Terms

15.1. Subject to the remainder of this section, Believ may amend these Terms from time to time by publishing an updated version on the Website and in the App. Please check the Terms published on the Website and in the App periodically for changes. If you do not agree to the updated Terms you must immediately stop using the Services, but your continued use of the Services including the Website, App and Believ Map will be deemed to provide confirmation that you agree to the updated Terms.

15.2. The changes Believ can make to these Terms, without your authorisation, are limited to the following:

(a) to reflect updates to the functionality, security, options and Services available on the Website and the App;

(b) to reflect third party terms and conditions that apply to Believ and/or the Website, App and Believ Map;

(c) that are generally beneficial to, or do not have any adverse impact on, users of the Services, the Website, App and Believ Map; and/or

(d) that are required to reflect changes to applicable law.

15.3. Believ will notify you and request your confirmation if necessary, via the Website and/or the App, that you agree to the updated Terms if the updated Terms incorporate any other changes not listed in section 15.2 above.

Part 16 – Business Users

16.1. If you are a Business User, these Terms constitute the entire agreement between us in relation to the Services. You acknowledge that you have not relied on any statement, promise, representation, assurance or warranty made or given by or on behalf of us which is not set out in these Terms and that you shall have no claim for innocent or negligent misrepresentation based on any statement made or given by or on behalf of us.

16.2. If you are a Business User:

(a) Believ is not liable to you for any loss (including any consequential or indirect loss) of income, business, goodwill, reputation, opportunity, anticipated savings or revenue, loss of use of property, whether in contract, in tort (including negligence), for breach of statutory duty or otherwise; and

(b) our aggregate liability to you under these Terms shall not exceed the amount paid by you to us for our Services.

Part 17 – General

17.1. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining sections will remain in full force and effect.

17.2. These Terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts.

17.3. You agree that we may transfer our rights and obligations under these Terms to another organisation. We will always notify you if this happens and we will ensure that the transfer will not affect your rights under these Terms. You may only transfer your rights or your obligations under these Terms with our prior written agreement which will not be unreasonably withheld or delayed. We may not agree if the proposed transfer affects our rights and obligations under these Terms.
